This website is owned and operated by Featherstone & Associates ACN 673 573 165 (Featherstone & Associates), registered in Queensland, Australia. These Terms of Use should be read in conjunction with our Privacy Policy.

Featherstone & Associates operates the website www.featherstone.law, as well as any other related products and services that refer or link to these legal terms of use (Terms of Use) (collectively, the Services).

By using this website, you are agreeing to be bound by these Terms of Use and any other laws or regulations which apply to this website. If you do not accept these Terms of Use, then you are expressly prohibited from using the services and you must discontinue use immediately.

Featherstone & Associates reserves the right to amend these Terms of Use from time to time, with any amendments effective immediately upon notification on this website. Your continued use of this website following such notification will represent an agreement by you to be bound by the Terms of Use as amended.

1. OUR SERVICES

Featherstone & Associates provides legal services in Australia, particularly in the areas of Competition and Consumer Law; Litigation and Dispute Resolution; Health, Sciences & Medicine; Small Business. The use of this website does not create a solicitor/client relationship nor do its contents constitute legal advice. The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction.

2. INTELLECTUAL PROPERTY RIGHTS

Our intellectual property

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the Content), as well as the trademarks, service marks, and logos contained therein (Marks).

5. USER GENERATED CONRTIBUTIONS

The Services does not offer users to submit or post content. We may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Services, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, Contributions). Contributions you transmit will be treated in accordance with our Privacy Policy.

Any Contributions which you upload or otherwise transmit to the Services is done so at your own risk. If you suspect issues with the security of this website or the Services generally, you must not upload Contributions to the Services, and must advise us immediately.

  • Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors.

If we terminate or suspend your client account for any reason, you are prohibited from registering and creating a new client account under your name, a name you were previously known by, a fake or borrowed name, or in the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account with us, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal and injunctive redress.

10. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. We have no obligation to update any information on our Services. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.

11. GOVERNING LAW

These Terms of Use shall be governed by and defined following the laws of Australia. Featherstone & Associates and yourself irrevocably consent that the courts of Australia shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Terms of Use.

12. DISPUTE RESOLUTION

Any dispute arising out of or in connection with these Terms of Use, including any question regarding its existence, validity, or termination, shall be referred to mediation, to take place in Brisbane, Australia, prior to any legal proceedings. The parties agree that any mediation shall be limited to the dispute between the parties individually.

The parties agree that the following disputes are not subject to the above provisions concerning mediation: (a) any dispute seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of the party; (b) any dispute related to, or arising from, allegations of theft, privacy, invasion or privacy, or unauthorised use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither party will elect to mediate any dispute falling within that portion of the provision found to be illegal or unenforceable and such dispute shall be decided by a court of competent jurisdiction within Brisbane, Australia, and the parties agree to submit to the jurisdiction of that court.

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time without prior notice.
